PROSECUTION OF CASES UNDER THE TOURISM INDUSTRY ACT 1992 [ACT 482]: RENEWAGE GROUP SDN. BHD.

PUTRAJAYA, 16 June 2025 – The Sessions Court, Georgetown, Penang has found that the company Renewage Group Sdn. Bhd. (Company No.: 1194895-H) (hereinafter referred to as the Defendant – “OKS”) has pleaded guilty and the Court has convicted OKS under Section 5(2), Tourism Industry Act 1992 [Act 482] and sentenced it under Section 5(3) of the same Act because OKS has carried on a tourism operation business that is not licensed under Act 482.

In today’s case, before the Sessions Court Judge, Mr. Irwan bin Suainbon, a fine of Ringgit Malaysia Thirty Thousand Only (RM30,000.00) was imposed and if OKS fails to pay the fine, OKS will be imprisoned for a period of twelve (12) months. The prosecution was conducted by Deputy Public Prosecutors Mrs. Siti Ruvinna binti Mohd. Rawi and Mrs. Siti Zulaikha binti Mahadi.

The Ministry of Tourism, Arts and Culture (MOTAC) stresses that offences under Act 482 are serious criminal offences and MOTAC will take appropriate action against any person who violates Act 482.

Such unlicensed activities can undermine tourist confidence and expose consumers to various risks including fraud, uncertain itinerary, lack of legal protection and unsafe tourism experiences. Therefore, MOTAC is committed to enhancing the enforcement of Act 482 to ensure that only legitimate tour operators are allowed to operate. This is essential to creating a safer, more competitive and responsible tourism industry environment.

The Ministry hopes that this case will serve as a reminder to all entrepreneurs in the tourism industry to be more responsible and ethical in carrying out business activities. In line with the aspirations of Malaysia MADANI which emphasises the values ​​of accountability, integrity and justice, MOTAC remains committed to ensuring that the country’s tourism industry develops legally, sustainably and benefits all levels of society.
